Shade IQ Terms of Use

1. Acceptance of these terms

By installing or using the Shade IQ app or any Shade IQ service, you agree to these Terms of Use. If you do not agree, please do not use Shade IQ.

2. What Shade IQ is

Shade IQ is a walking navigation aid that suggests routes based on estimated shade coverage from tree canopy and building shadows. It is provided as a planning tool — not as a medical device, not as a safety device, and not as an emergency service. Shade IQ does not diagnose, prevent, or treat any condition including but not limited to sunburn, dehydration, heat exhaustion, heatstroke, skin cancer, or photosensitivity.

3. Use at your own risk

Routes and shade estimates are predictions based on third-party map, elevation, and weather data that may be incomplete, outdated, or inaccurate. You are solely responsible for your own safety, including awareness of traffic, terrain hazards, weather changes, and your personal physical condition. Always exercise judgment about whether a route is safe and appropriate for you.

Shade IQ grants you a limited, non-exclusive, non-transferable, revocable license to use the app for your personal, non-commercial purposes, subject to these Terms. You may not reverse-engineer, redistribute, or commercially exploit the app or its data.

6. Third-party data and services

Shade IQ relies on third-party data sources (OpenStreetMap, ESA Copernicus DEM, Open-Meteo, Apple Maps, and others described in the in-app Licenses page). We make no warranties about the accuracy or availability of those services. Their respective terms and licenses also apply where relevant.

7. No warranties

Shade IQ is provided "as is" and "as available," without warranty of any kind, express or implied, including but not limited to fitness for a particular purpose, merchantability, or non-infringement. We do not warrant that the app will be uninterrupted, error-free, or secure.

8. Limitation of liability

To the maximum extent permitted by law, Shade IQ and its developers are not liable for any injury, illness, property damage, lost data, lost time, or any direct, indirect, incidental, consequential, or punitive damages arising from your use of the app or inability to use it — including reliance on routing suggestions or weather information.

Shade IQ is intended for general adult use (13+). Parents or guardians are responsible for supervising any minors who use the app.

10. Changes to these terms

We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the latest version. Continued use of Shade IQ after a change means you accept the updated Terms.

11. Governing law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws principles.

12. Apple App Store-specific terms

The following terms are required for any application distributed through the Apple App Store. They apply in addition to the terms above and, where in conflict, control to the extent necessary for compliance with Apple's developer requirements.

Acknowledgement. You and the developer of Shade IQ (the "Developer") acknowledge that this Agreement is concluded between you and the Developer only, and not with Apple Inc. Apple is not responsible for Shade IQ or its content. The Developer, not Apple, is solely responsible for Shade IQ, including its support, maintenance, and any claims relating to it.

Scope of license. The Developer grants you a limited, non-transferable license to use Shade IQ on any Apple-branded products that you own or control and as permitted by the App Store Terms of Service. Family Sharing is permitted where applicable.

Maintenance and support. The Developer is solely responsible for any maintenance and support services for Shade IQ. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the app.

Warranty. The Developer is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of Shade IQ to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the app to you (if any). To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to Shade IQ.

Product claims. The Developer, not Apple, is responsible for addressing any claims by you or any third party relating to Shade IQ or your possession and/or use of Shade IQ, including (i) product liability claims; (ii) any claim that the app fails to conform to any applicable legal or regulatory requirement; (iii) claims arising under consumer protection, privacy, or similar legislation; and (iv) claims arising in connection with the HealthKit, HomeKit, or similar Apple frameworks (none of which Shade IQ uses today).

Intellectual property rights. In the event of any third-party claim that Shade IQ or your possession and use of it infringes that third party's intellectual property rights, the Developer — not Apple — will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

Legal compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

Third-party terms. You must comply with applicable third-party terms of agreement when using Shade IQ (for example, your wireless data service agreement, or the licenses of the data sources listed on the in-app Licenses page).

Third-party beneficiary. You acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of this Agreement, and that, upon your acceptance of the terms and conditions of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary thereof.
